Utilities

Question.

Have you guys gotten your year end statements yet? We have for our water and garbage. We haven't gotten anything for our Water. In fact, they haven't pulled anything since December.

I've e-mailed the company and they have no record of our payments; but, I do. (i.e. bank statements) The Vat office said because our town is way out there, it would go to our landlord. I haven't heard from him yet either.

In my last e-mail to the Water company, I gave the LL information, our house information, and our payment to them each month. Will they give me any information considering it is being pulled from our account? I hate being behind in payments. They $$ is there; but, I worry we went over and will have to pay more then is there.

Any suggestions?

Do you pay the water company directly or are you paying the landlord? It is normal in the KMC area to pay the Landlord for water and he sends you an annual bill. I lived in Quirnbach and Otterberg and in both places I paid the Landlord (it should be annotated in your contract).

Under German law, the landlord has 12 months after annual billing cycle to bill you, or he loses his right to any monies you may owe.

Here is a quote from the Kaiserslautern Legal Services Center paper on German Landlord Tenant Law:

"Utilities are just advance payments. Consequently, they are only estimates of how much it will cost. The landlord rarely agrees to a fixed amount. However, the landlord will have to present to the tenant a detailed list of the overall actual utility costs, unless the parties agreed on a fixed amount. Such a list has to be presented within 12 months following the (annual) billing cycle, otherwise the landlord is prevented from asking for additional amounts to cover the actual annual utility and operational costs (§ 556 para. 3 BGB). Likewise the tenant has 12 months, following the receipt of the landlord's list on utility and operational costs to present any objections he/she might have or else be loose the right to protest."

Water = I pay my landlord, who in turns gives me the bill so I can be reimbursed.

Gas and electric = I pay the respective companies myself

Definitely check with your landlord - something doesn't sound kosher here. If you can't get a good answer from either of them, make an appointment with the German Legal Office on base - they should be able to help you straighten it out.

When I had my massage this morning, (loved it!) the lady is a German national. She lives in a village close to us. She said, the water company is late this year. They haven't sent out the statements yet. She was told to wait until mid March for it. Just keep the money in our account because they will pull it all at once for the three months.

I'm thinking, I might ask to have myself pay instead of letting them pull.
